Range of Work

Employment law is a very dynamic and frequently changing area of the law which is particularly affected by European legislation.

Borneos covers all aspects of employment law as it applies in England and Wales.  The following areas are the ones which our clients tell us they find important:

 

• employment and HR policies and procedures, including recruitment, disciplinary and grievance procedures, employment relations and obligations under the Information and Consultation Regulations
  
  
• contracts of employment – Statement of Particulars to comply with the Employment Rights Act 1996 and additional terms to include, for example, pay and benefit schemes, restrictive covenants and confidentiality agreements
  
  
• employment implications of business sales and transfers including the infamous TUPE (Transfer of Undertakings, Protection of Employment) Regulations, business restructuring, and introducing changes to employment contracts
  
  
• unfair and wrongful dismissal issues and discrimination claims (e.g. for reasons related to race, sex, disability, religious belief and, shortly, age)  
  
  
• maternity, paternity and parental rights, handling requests for flexible working and long term or frequent sickness absence
  
  
• compliance with maximum working hours, minimum paid holidays and other entitlement to time off work, minimum wages, health and safety at work issues
  
  
• individual and collective redundancy procedures and other dismissal procedures, negotiating termination packages and compromise agreements
  
  
• dispute resolution, preparation for and advocacy at tribunal hearings.

Employment law issues are often urgent and sometimes require immediate advice and assistance. We will provide an initial assessment and tactical brief on the issue as rapidly as possible and are happy to visit you to discuss the problems and assess the situation.

Borneos conducts seminars on a variety of employment topics and we are available to provide in-house training. By raising managers’ and supervisors’ awareness of the importance of good employment practice, we can help you to reduce the risk of disputes arising. For example, unlawful discrimination or constructive dismissal claims can result simply from a lack of understanding of employment law or mistakes made by inexperienced staff when dealing with their colleagues or subordinates. Methods of Payment

Our charges are normally made on the basis of an hourly rate for the time taken.  In some circumstances we can agree a fixed charge in advance. We may agree payment by instalment or on the basis of a retainer fee, if that will assist cash-flow.   We can also liaise with you and insurance providers for legal expenses insurance cover in the event that you do need to defend employment claims in court or tribunal.
